SC08-944 – Dane Patrick Abdool vs. State of Florida Abdool filed the following claims in Direct Appeal: (1) denial of motion for judgment of acquittal because the evidence did not prove premeditation, (2) allowance of detective's opinion on whether victim's death was accidental, (3) allowance of irrelevant evidence, (4) order of defense counsel to turn over the raw data used by its mental health expert prior to the penalty phase, (5) prosecutor elicited improper, inflammatory, and irrelevant evidence during the penalty phase, (6) victim-impact evidence was irrelevant and prejudicial and denied Abdool due process, (7) cold, calculated, and premeditated aggravator and failure consider weighty mitigation, (8) proportionality of death sentence, and (9) Ring v. Arizona.
FSC affirmed conviction and sentence.
