Circumstances of Offense:
Glen Edward Rogers was convicted and sentenced to death forthe murder of Tina Marie Cribbs.
On 11/05/95, Tina Marie Cribbs was seen leaving the ShowtownBarn in Tampa with Glen Edward Rogers. On 11/07/95, a cleaning personfound Cribbs in a Tampa motel room. She had been stabbed in the chest andthe buttocks. According to Cribbs’ mother, Tina always wore a sapphireand diamond ring and a gold watch. These pieces of jewelry were not foundwith Cribb’s body.
A bartender told police that Rogers had bought drinks forCribbs and her friends. Later, Rogers asked Cribbs for a ride. Cribbs told her friends that she would be back shortly to meet hermother. Cribbs’ mother arrived at the bar and paged Cribbs because shehad not returned to the bar.
A motel clerk said that Rogers had arrived in a cab at themotel a few days prior to the murder. On 11/05/95, Rogers paid foranother night and asked that no one clean his room. The clerk thenobserved Rogers packing suitcases into a White Ford Festiva. On 11/13/95,Rogers was arrested in Kentucky driving Cribb’s car, which he claimed a girlhad loaned him. Rogers also claimed that the girl was alive when he left.
Several days earlier, on 11/06/95, Cribbs wallet was foundat a rest area on Interstate-10 in North Florida. Fingerprints liftedfrom the wallet and the Tampa motel room were matched to Rogers.
Additional Information:
On 07/09/97, the State of California indicted Rogers oncounts of First-Degree Murder and Arson. The governors of California andFlorida reached an extradition agreement that would extradite Rogers toCalifornia to stand trial. Rogers would then be transported to Florida toserve his sentence once the trial in California was completed.
Rogers was extradited to California in October of1998. He stood trial for strangling Sandra Gallagher and leavingGallagher’s body in her burning automobile. Rogers was convicted ofFirst-Degree Murder and Arson on 06/22/99 and sentenced to death on07/16/99. He then was transported back to the control of Florida’sDepartment of Corrections in August of 1999.

Factors Contributing to the Delay in Execution ofSentence:
The Direct Appeal was pending for four years prior to adecision being rendered due to Rogers’s extradition to California to standtrial for First-Degree Murder.
Case Information:
Glen Rogers filed his Direct Appeal in the Florida SupremeCourt on 09/11/97. He raised several issues on appeal. One issuewas that the State of Florida did not present sufficient evidence to supportthe charges. Another issue was that the trial court erred in the handlingof mitigating circumstances. Rogers also argued that the trial courtshould have granted the defense’s motions for a mistrial because a witness wasallowed to testify about a misdemeanor for which Rogers was convicted in California;the prosecution was allowed to present an improper argument during closingarguments, and because the Hillsborough State Attorneys’ office was allowed toprosecute the case. Rogers also contended that there was newly discoveredevidence and that the sentence of death was not proportionate to the crimecommitted. The Florida Supreme Court affirmed the conviction and sentenceon 03/01/01. Rehearing was denied on 04/24/01. A mandate was issuedon 06/06/01.
Rogers filed a Petition for Writ of Habeas Corpus on10/13/97 with the Bradford County Circuit Court. The Circuit Court deniedthe petition and granted the extradition of Rogers to California in order tostand trial for First-Degree Murder and Arson on 12/08/97.
Rogers filed an Appeal of the Habeas Corpus Denial and theOrder of Extradition to California on 01/05/98. The Florida Supreme Courtaffirmed the decisions of the Circuit Court to deny the Petition of HabeasCorpus and to grant extradition to California on 05/14/98. Rehearing wasdenied on 07/10/98. A mandate was issued on 11/13/98.
Rogers filed a 3.850 Motion with the circuit court on09/28/01. He filed amended motions on 07/18/02 and 05/08/03. Themotion was denied on 03/08/05.
