Circumstances of Offense:
Charles Globe was an inmate in Columbia CorrectionalInstitution in July of 2000. He and a fellow inmate, Andrew Busby, planned tokill an inmate or correctional officer. For two weeks, Globe and Busby createda list of seven potential victims, one of which was Busby’s cellmate, EltonArd. Globe and Busby talked for days about killing Ard and developed a plan todo so. Using part of a linen sheet and broken ballpoint pens, Globe made twogarrotes to strangle Ard.
On the morning of 07/03/00, Globe slipped into Ard’s and Busby’s cell. After locking the cell door and covering the window, Globe grabbedArd around the neck and they struggled. Globe placed one of the garrotesaround Ard’s neck, but it broke as Globe and Busby strangled Ard. Ard pled forhis life, offering money to Globe, but he struck Ard in the face, causing himto bleed. Globe flushed the broken garrote down the toilet and tied the secondgarrote around Ard’s neck. Globe lit a cigarette and watched Ard gasp for airsix times before he finally died. After Ard’s death, Globe tied the garrotearound Ard’s wrist, lit a cigarette and put it in Ard’s mouth, and placed alighter in Ard’s hand.
During a prisoner count later that morning, a correctionalofficer found Globe locked inside Ard and Busby’s cell. Ard had a cigarette inhis mouth but appeared to be dead. Abrasions and other marks were visible onGlobe’s face. Evidence recovered from the crime scene included photographs ofwriting on the prison wall, photographs of bloody fingerprints, the cigarettelighter and cigarette found on Ard, and a magic marker used to write on thewall. In handwriting determined to be Globe’s, the words “Call FDLE,” and“Remember Andy and K.D., 7/3/2000,” and “Don’t forget to look on the door” werewritten on the cell walls.
Several hours after the murder, Globe and Busby were read theirMiranda warnings and gave a tape recorded statement to FDLE agents, confessingto the Ard murder. On 07/07/00, Globe was again read his Miranda warning by Departmentof Corrections officials and again confessed to the Ard murder.

Globe filed a DirectAppeal with the Florida Supreme Court on 01/07/02, citing the following errors: denying a motion to suppress statements to FDLE investigators, admitting Busby’sconfession, improper penalty phase and jury instructions, Ring claims, impropersentencing order, disproportionality of the death penalty, and failing toconsider mitigating circumstances. On 03/18/04, the FSC affirmed the conviction and sentence.
Globe filed a 3.851Motion with the Circuit Court on 09/30/05 and amended the motion on 08/07/06. The motion was pending at the time of Globe’s death.
