GROSSMAN, Martin (W/M)

DC#:   089742

DOB:   01/19/65

Sixth Judicial Circuit, Pinellas County Case # 84-11698

Sentencing Judge: The Honorable Crockett Farnell

Attorney, Trial: Thomas B. McCoun, III – Private

Attorney, Direct Appeal:  Elizabeth Mansfield – Private

Attorney, Collateral Appeals: Richard Kiley and James Viggiano– CCRC-M

Date of Offense:           12/13/84

Date of Sentence:         12/13/85

Circumstances of Offense:

On the night of 12/13/84, Martin Grossman and a companion, Thayne Taylor, drove to a wooded area in Pinellas County, Florida, and were shooting a stolen handgun when they were approached by Margaret Park, a Florida Wildlife Officer.

Park confiscated the weapon and license of Grossman, at which point Grossman pleaded with her to not report him for possessing a weapon and being outside of Pasco County, both of which were violations of his probation for a burglary charge.  Park picked up the radio to call the sheriff’s office, but was repeatedly struck on the head and shoulders with her flashlight by Grossman and was then beaten by Taylor.  She managed to exclaim “I’m hit” over the radio, and deputies from the Pinellas County Sheriff’s Office began responding to her location. Park drew her weapon and fired a shot within the vehicle, and disabled Taylor with a kick to the groin.  Grossman, who was one foot taller and one hundred pounds heavier than Park, wrestled the weapon away from her and shot her once in the back of the head.  Grossman and Taylor fled the scene with Grossman’s license, gun, and Park’s gun.

When they returned to Grossman’s home, both Grossman and Taylor told Brian Hancock about the incident. Hancock and Taylor then buried the two guns near the crime scene while Grossman attempted to discard the clothing and shoes he had been wearing during the attack, because they were covered in blood. After they would not burn, he discarded them in a lake nearby. The following day, Grossman and Taylor cleaned the van that was used in the attack and changed the tires.

On 12/20/84, Grossman and Taylor retold the story of the shooting incident to another friend, Brian Allen. Hancock, who testified that he was scared of Grossman, informed the police on 12/25/84 about the event. Soon after, Grossman and Taylor were arrested. Taylor, subsequently, confessed to the police. Grossman also told one more person, a fellow inmate, about the killing.

Factors Contributing to the Delay in Imposition of Sentence:

The delay in the imposition of the sentence arises from the time taken to decide the FSC Habeas petition (03/23/90 – 12/18/97) and the Circuit Court 3.850 motion (08/13/90 – 10/05/95).  The current delay arises from the Federal Petition for Writ of Habeas Corpus that was pending from 09/18/98 – 01/31/05.
